Microsoft and SIK conclude Addendum to DPA to facilitate the Public Sector going into the Cloud

Niederer Kraft Frey acted as counsel to Microsoft Switzerland GmbH in the negotiations of an Addendum to the Microsoft DPA of July 2020 for Online Services.

Microsoft is a leading American multinational technology company with headquarters in Redmond, Washington. It develops, manufactures, licenses, supports, and sells computer software, consumer electronics, personal computers, and related services.

SIK (Swiss ICT Conference) was founded in 1975 by the Conference of Cantonal Finance Directors (FDK), the ch Foundation for Federal Cooperation, the Confederation and the majority of the cantons. Today the Confederation, all cantons, the Principality of Liechtenstein and numerous cities and municipalities are members. Its aim is to promote community cooperation in the field of administrative digitisation. In doing so, the SIK wants to be the leader in this field, to coordinate and promote the exchange of information.

SIK and Microsoft have been cooperating for many years and also concluded for this purpose a Framework Agreement. In order to facilitate that the SIK members can go into the cloud and subscribe to Microsoft Online Services, the parties together jointly developed an Addendum to the current Microsoft DPA.
